Call to Order:  

The meeting was called to order by President Scahill at 12:40 p.m.

 

Previous Board Meeting Minutes:  

The previous Board meeting minutes were not discussed

 

EPEPOA President Confirmation:

Following the resignation Susan Hampton as president of the association at the

July 1, 2017, Annual Meeting, Joyce Scahill was confirmed as our new Board president. Mrs. Hampton’s request to remain as an alternate Board member was approved, with our thanks.

 

Old Business:  

Short-Term-Rentals – The subject of short-term rentals, discussed at the Annual Meeting on July 1, 2017, and at prior Board meetings, was further discussed by the Board.

The Board unanimously agreed with the observations expressed by the general membership that the renters of the two short-term-rental properties have routinely violated our CC&R’s in terms of noise, lighting, parking on the streets, pets off leash and general disrespect for full-time residents, thereby damaging the livability of our neighborhood. Additionally, a proliferation of short-term rental homes in EPE will most likely alter the single-family character of our neighborhood and cause a marked decrease in our property values, according to Mr. Alan Roth, General Manager, Pagosa Lakes Property Owners Association (PLPOA).

After hearing the open–forum discussion by EPE property owners on the subject of short-term-rentals at the Annual Meeting, a decision was reached to draft a covenant change by amendment to phase out and prohibit short-term rentals of less than 30 consecutive days, effective June 30, 2019. The proposed amendment language will also limit the number of renters in a home to no more than 10 persons and renter vehicles to a maximum of four. A 67% approval by property owners will be required to implement the change.

 

New Business:

After numerous e-mails and discussions with owners closest to the two rental properties, the Board unanimously agreed to look at how to best establish written rules & regulations for renters, regardless of whether the short-term-rental amendment is passed by owners or not. Generally, the renter rules will encompass the following:

 

  • No excessive noise after 10:00 p.m. or before 7:00 a.m.
  • All exterior lights off by 10:00 p.m.
  • A maximum of four vehicles per home rental
  • No vehicle parking on the streets
  • A maximum of ten persons per home rental  
  • Pets must be on leashes
  • The EPE Community Dock is for the exclusive use of homeowners only
  • Exercise a general respect for home owners and their property
  • Home owners are responsible for their renters’ actions/violations
  • Notices and fines to property owners for violations of the rules & regulations

 

Attorney Selection – President Scahill solicited input from Board members and recommended that the association select an attorney to represent the association, particularly concerning the wording & correct procedures for new amendments, voting and general legal matters. Also, our covenants are several years old and should undergo a complete legal review. She recommended the law firm of Newbold, Chapman and Geyer, Durango Colorado. The Board members agreed to the law firm selection proposed by President Scahill. A meeting will be scheduled with a member of the firm.  

 

President’s Report:

President Scahill requested that the minutes of the July 1, 2017, annual meeting be prepared as soon as possible so that it may be distributed to the members in a timely manner to reinforce the group consensus concerning short-term-rentals and to make owners who were not present at the Annual Meeting aware of the situation.

President Scahill also requested that the new EPE Fourth Amendment concerning the storage of RV vehicles, approved at the July 1, 2017, Annual Meeting by a greater than 67% vote of the members, be signed by the president and secretary, notarized and recorded with the Archuleta County Office of Clerk and Recorder as soon as possible.

 

Voting – All ballots for new amendments or other association business shall have a firm drop-dead return due date. The return date shall not be voiced as a request in the future.  

 

Treasurer’s Report:

EPE Treasurer Glenn Woodruff reported that 28 of the 38 property owners were represented at the July 1, 2017 Annual Meeting.

 

Next Annual Meeting:

The date of the next Annual Meeting of the Pagosa Estates Property Owners’ Association is to be determined.  President Scahill will distribute notices to the members.
